A Sheriff’s Gotta Do What The Law Says. Unless They Don’t.
The thing that separates the rule of law from the rule of tyrants is that it is what it is and enforces itself equally, no matter who or what is subject to it. But for the Claremont Institute (read: the group that coup author John Eastman hangs around), opting in and out of the law appears to be worthy of a scholarship. Not for you bright-minded 0Ls out there — for the sheriffs.
This appears to be an about face, as the money comes from the “he should have complied” people. Eight “Constitutional Sheriffs” — the title the law refusers opt to go by — will be treated to a trip most FedSoc members could only dream of including but not limited to lectures on Locke (gotta love property), English legal history, and how to throw a trap house party without causing a media debacle.
It is a strange move for the Claremont Institute to uplift and reward sheriffs who have pledged to enact what is functionally “Sheriff’s review” of the constitutionality of state and federal laws. Much of the sheriff-flavored defiance so far has been with regard to COVID mandates, but there are no clear barriers in place besides an amorphous and politically dependent notion of liberty that limits the type of authority these sheriffs and the Institute want recognized. It’s a sovereign citizen legal Wild Wild West mashup and I don’t know the endgame. Hopefully these sheriffs and whatever law suspension or deputizing they end up doing isn’t just grounds for a new Tulsa.
